California authorities filed a lawsuit against the rules allowing home delivery of marijuana

In the High Court of Fresno County, California, 25 local government representatives filed a class action lawsuit against a rule that allows delivery of marijuana to a statewide home. This April 5 reported by AP.

The California Cities League (The League of California Cities Association) and the police chiefs believe that unlimited home delivery of marijuana creates an uncontrolled market in which a large number of hidden product operations will prevail. Thus, in their opinion, this undermines control of cannabis, writes Rtvi.

Chairman of the Supervisory Board of the District of Santa Cruz, Ryan Kunerti, stated that this rule is detrimental to local marijuana plants and “violates the promise made to voters” in 2016. Plaintiffs ask the court to invalidate the rule and prohibit state regulators from applying it.

Companies and consumers of cannabis insisted on the delivery of the product to the house due to the fact that it can only be bought in certain places, and the staff itself is quite long. Thus, some residents of remote areas were actually cut off from the possibility of legally acquiring marijuana.

The recreational cannabis law 2016 of the Year states that local authorities have the right to prohibit the operation of stores that sell more than just medical cannabis. But government regulators also pointed out a code of business ethics. It states that local governments “should not interfere with the delivery of cannabis or its products on public roads,” if operators have a permit.

It is reported that the State Cannabis Control Bureau did not immediately respond to a request for comment.

Recreational use of marijuana is permitted in ten US states: Alaska, California, Colorado, Maine, Massachusetts, Michigan, Nevada, Oregon, Vermont, as well as in Washington and the Northern Mariana Islands. In addition, cannabis can be used for medical purposes in US states 33.

Recall that in the US there are cases denial of citizenship to legal immigrants, holders of green cards that work in industries related to marijuana. In this case, the authorities rely on federal law, not state law, where marijuana is allowed.
