The construction of Trump’s border wall has been criticized by numerous groups and states who have claimed that the administration has bypassed Congress to secure a fund to build the wall.

In September 2019, the head of the Department of Defense, Mark Esper, authorized the allocation of $ 3,6 billion for the construction of a wall on the southern border with Mexico. At that time, the Pentagon stated that part of the money comes from deferred projects abroad, and part was planned for projects in the United States.

A court decision authorizing the use of the military budget does not apply to the involvement of other funds, including counter-narcotic and treasury funds.

In February 2019, Trump completed the 35-day shutdown when Congress allocated him $ 1,4 billion to finance the wall, which is much less than he wanted. Subsequently, Trump declared a state of emergency in the country in order to receive money from other accounts for its construction.

Trump has repeatedly stated "huge amounts of drugs" crossing the US border from the southern border - even though most of these drugs go through ports of entry. He also spoke about the problem of human trafficking.

A lawsuit filed by El Paso County (Texas) and the Human Rights Society alleges that Trump exceeded his authority when he introduced an emergency national declaration to gain access to additional funds for his border wall, despite receiving $1,375 billion from Congress.

Christie Parker, lawyer for the non-partisan nonprofit organization Protect Democracy, emphasized: “The court has already established that the government cannot legally use military means to build Trump’s border wall.”

“Unfortunately, El Pasoans will continue to suffer while the government appeals, but we are confident that we will prevail again in the next phase of litigation,” she said.
