US relaxes procedures for issuing certain visas and suspension of deportation
US Citizenship and Immigration Services (USCIS) has reached a settlement in Wangala et al. V. USCIS. The agreement allows certain individuals to receive updated dates for receiving resubmitted applications for immigration benefits or petitions initially rejected under the previous No Gaps policy. Under previous policy, USCIS rejected applications with blank fields or spaces. This is stated in a press release from USCIS.
On July 20, 2021, the Oakland District Court for the Northern District of California finally approved the settlement. This agreement refers to the No Spaces opt-out policy, which applied to three forms:
- Form I-589, Application for Asylum and Withholding of Removal
- Form I-918, Petition for Nonimmigrant Status U
- Form I-918 Appendix A Petition for Qualified Family Member of U-1 Recipient

Previously, these forms could be rejected if the applicant:
- Leaves required fields blank.
- Does not answer questions related to filing requirements.
- Omitting any required initial data.
Individuals whose forms were rejected under the previous policy may resubmit their request no later than July 20, 2022.
Individuals who resubmitted these forms prior to the effective date of this settlement (July 20, 2021) may also submit documentation no later than July 20, 2022 in order to receive an updated date.

USCIS also agreed to notify affected individuals who may benefit from the settlement agreement.
USCIS recommends that affected individuals familiarize themselves with settlement agreement for specific information about resubmitting an application or petition.
