Immigration officials were instructed to reunite only those parents and children who refused to submit asylum requests and agreed to leave the United States through deportation. ICE provided a document for familiarization to parents who were detained, in which there are two options: put a signature on the text of reunification with the child, followed by repatriation to the country of citizenship, or put a signature on the clause on returning to the country of citizenship without a minor child, which will remain in USA and will wait for the decision to provide assistance.

Agents received instructions that the form should be read in the language that the immigrant understands (usually Spanish), but for other languages ​​and dialects it can be difficult to find Americans who can read the paper so that they understand. As the spokesman said the immigration service, the order is intended for those immigrants, which have already made a final decision on deportation, although under American law such an immigrant can still apply for asylum.

Lawyers say that forcing parents separated from children to immediately choose one of the options to be expelled from the country actually indicates a denial of asylum.
