Simferopol court found Crimean guilty of misconduct

The Kremlin-controlled court of Simferopol convicted the Crimean Tatar (the convict asks not to publicly give his name for security reasons) of non-reporting and fined him 10 thousand rubles (more than 150 dollars). According to the investigation version of the FSB of Russia, the accused did not inform the law enforcement agencies that his relative had left to fight in Syria on the side of ISIS.

The defense believes that the sentence is “absolutely unfounded” and intends to appeal the judge’s decision.

“I believe that the grounds provided as evidence of my client’s guilt were not confirmed during the judicial investigation,” said lawyer Lilya Gemedzhi. – The expert was unable to explain how the prosecution discovered correspondence for 2017 on a phone purchased in 2016. An investigative experiment in the courtroom confirmed that by changing the date and time on the phone, it is possible to create such correspondence retroactively. However, the judge did not pay any attention to this. This attitude remained throughout the entire trial.”

In Crimea, this is the first precedent after the adoption of amendments to Russian legislation as part of the so-called “Yarovaya package.” The article on non-reporting implies liability in the form of a fine of up to 100 thousand rubles (more than $1500) or imprisonment for up to a year.

In Russia, the first sentence under the article “failure to report a crime” was handed down in 2017. The court fined a resident of Astrakhan 70 thousand rubles (more than $1100) because he knew that his acquaintance “was trained in a militant camp and fought on the side of terrorists,” but did not report this to law enforcement agencies.
